The attorneys at Nass, Roper, & Levin, PC have a proven track record of litigating on behalf of New York City prison inmates who have suffered abuse at the hands of corrections officers. Rikers Island is an island between Queens and the Bronx that houses New York City’s jail complex and mental institution. The Rikers Island jail is the second largest jail in the United States.

Many recent scandals have marred the reputation of Rikers Island, most caused by correctional officers using excessive force and causing severe injuries to prisoners such as collapsed lungs, broken bones, spinal fractures, perforated eardrums, and eye injuries, as well as death.

While some constitutional rights are limited in scope for prisoners, the Eighth Amendment’s prohibition against cruel and unusual punishment applies. Courts have interpreted this right to ensure that prisons afford prisoners a minimum standard of living. For example, an overcrowded jail might not meet the minimum standard of living required by the Constitution.

The Equal Protection Clause of the Fourteenth Amendment protects prison inmates against unequal treatment based on race, sex, and creed. Prisoners also enjoy the rights to free speech and the free practice of religion guaranteed by the First Amendment.

In 2015, after receiving numerous police brutality allegations, the Justice Department intervened and reached a consent settlement with the department of corrections that included over 300 provisions that the facility must implement. Examples of these new provisions include more staff training, more security cameras, and more significant disciplinary actions for correctional officers who use excessive force.

Even with these more stringent requirements, correctional officers still violate the civil rights of Rikers Island prisoners through excessive force. We want to put a stop to civil rights abuses in prison by fighting for our clients to win their civil rights lawsuits and receive compensation for the abuse they endured at Rikers Island.
